Terms & Conditions
Effective Date: January 1, 2026
1. Acceptance of Terms
By enrolling a child at Kid’s Time Childcare (“Provider”), located at 79 Alvarado Ave, Worcester, MA 01604, you (“Parent/Guardian”) acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions. These Terms constitute a binding agreement between Parent/Guardian and Kid’s Time Childcare.
2. Licensing & Regulatory Compliance (Massachusetts EEC)
Kid’s Time Childcare operates as a licensed family childcare provider in the Commonwealth of Massachusetts and complies with regulations established by the Massachusetts Department of Early Education and Care (EEC).
Parents are entitled to review copies of EEC regulations governing family childcare homes. EEC may be contacted directly for regulatory information or concerns.
3. Non-Discrimination Policy
Kid’s Time Childcare does not discriminate on the basis of race, color, religion, national origin, sex, disability, sexual orientation, gender identity, or any other protected category under Massachusetts or federal law.
4. Enrollment Requirements
Enrollment is not final until all required forms, immunization records, emergency contacts, signed policies, and applicable fees are received. Providing false, misleading, or incomplete information may result in immediate termination of services.
5. Payment Obligations
- Tuition is due as agreed in the signed Payment Agreement.
- Tuition is owed regardless of child absence, illness, holidays, or weather-related closures unless otherwise specified in writing.
- Late payments may incur fees.
- Accounts more than 5 days overdue may result in suspension of care.
- Unpaid balances may be sent to collections and may incur legal fees.
6. Assumption of Risk & Liability Limitation
Parent/Guardian understands that participation in childcare activities involves inherent risks including, but not limited to, minor injuries, falls, playground incidents, and accidental contact between children.
By enrolling, Parent/Guardian voluntarily assumes all ordinary risks associated with childcare participation. Kid’s Time Childcare shall not be held liable for injuries, losses, or damages arising from ordinary negligence. Liability is strictly limited to cases of gross negligence or willful misconduct as determined by a court of law.
Under no circumstances shall Kid’s Time Childcare be liable for indirect, incidental, consequential, or punitive damages.
7. Emergency Medical Authorization
In the event of a medical emergency, the Provider is authorized to secure emergency medical treatment for the child. Parent/Guardian accepts full financial responsibility for all medical costs incurred. The Provider shall not be held liable for outcomes of medical treatment administered by licensed medical professionals.
8. Illness & Exclusion Policy
Children exhibiting symptoms of contagious illness, fever, vomiting, diarrhea, or other conditions as defined by Massachusetts EEC health regulations will be excluded from care. The Provider reserves sole discretion to determine whether a child is well enough to attend.
9. Late Pick-Up Policy
Parents must pick up children at the scheduled time. Late fees apply per the signed Late Pickup Policy. Repeated violations may result in termination of services. If a child is not picked up and no contact can be made, emergency contacts or authorities may be contacted in accordance with Massachusetts law.
10. Termination of Services
Either party may terminate care with written notice as outlined in the Termination Policy. Immediate termination may occur for:
- Non-payment
- Violation of policies
- Aggressive or unsafe behavior
- Failure to cooperate with required procedures
- Threatening or inappropriate conduct toward staff
11. Vacation & Holiday Closures
The Provider reserves the right to close for holidays, vacation, illness, emergency, or unforeseen circumstances. Tuition policies during closures are governed by the signed Vacation & Holiday Policy.
12. Photo & Media Consent
Photographs or recordings of children will only be taken and used with written parental authorization. No identifying information will be published without consent.
13. Indemnification
Parent/Guardian agrees to indemnify and hold harmless Kid’s Time Childcare and its owner from any claims, damages, liabilities, costs, or legal expenses arising from the child’s participation in care, except in cases of proven gross negligence or intentional misconduct.
14. Governing Law & Dispute Resolution
This agreement shall be governed by the laws of the Commonwealth of Massachusetts. Any legal dispute shall be resolved exclusively in the courts located in Massachusetts. Parent/Guardian agrees to attempt good-faith mediation before pursuing litigation.
15. Policy Updates
Kid’s Time Childcare reserves the right to modify these Terms & Conditions at any time. Updated policies will be provided in writing. Continued enrollment constitutes acceptance of revised terms.
